Set forth below are the Official Rules and Regulations (“Promotion Rules”) for the "Hog Rustler Brands Inc. Break Any State All-Tackle State Record Largemouth Bass Record and Win $10,000.00 Cash" (the “Promotion”) sponsored by Hog Rustler Brands Inc. (“Promotion Sponsor”).  The Promotion Rules include other rules incorporated by reference.   The award of any prize in the Promotion is conditioned on, and subject to, strict compliance with the Promotion Rules below:

1.     Overview.   Anglers will compete to catch a State Record Largemouth Bass and Break the Current Largemouth Bass Record In any US State (Excluding Alaska) in the attempt to Win One of THREE $10,000.00 cash prizes as offered by Hog Rustler Brands Inc. If said angler breaks the All-Tackle State Record in any US State (Excluding Alaska) they will win the $10,000.00 Prize, if said All-Tackle State Record Fish is caught with a Hog Rustler Brands Inc. Lure. Employees, agents, successors, and assignees of Hog Rustler Brands Inc., its advertising agencies and promotional companies involved in this Promotion, as well as family and household members of same, shall be ineligible to participate in this Promotion and shall be ineligible for any prize covered herein. Contestants acknowledge that Hog Rustler Brands Inc. is not liable for payment of any prizes otherwise payable to contestants who are in violation of this provision.

2.     Contest Period.  The contest period (“Contest Period”) will begin at 12:00.01 a.m. EST , January 01, 2005 and end at 12:59:59 p.m. EST December 31 -2005. No prizes will be awarded to any contestant presenting a All-Tackle State Record Fish for redemption that has been caught other than during the Contest Period.  THIS MEANS THAT ANY All-Tackle State Record Fish THAT IS CAUGHT OUTSIDE THE CONTEST PERIOD ON ANY DAY OF THE CONTEST,  WILL NOT BE A WINNER.  Furthermore, no prizes will be awarded to any contestant presenting a All-Tackle State Record Fish for redemption after the expiration of the Contest Period.  THIS MEANS THAT ANYONE PRESENTING A All-Tackle State Record Fish IN ACCORDANCE WITH THE CONTEST RULES AFTER THE CONTEST PERIOD IS TERMINATED  WILL NOT BE A WINNER.  Hog Rustler Brands Inc. has no obligation to extend or reschedule the Contest Period due for any other reason.

3.     Rights To Promotional Advertising  Names and likeness of  Promotion Winner(s) may be used by Hog Rustler Brands Inc. and Hog Rustler Brands Inc. designee(s) for promotional purposes without further compensation from Hog Rustler Brands Inc. or the Promotion Winner(s). Each winner, if any, is responsible for paying any and all taxes on any prize(s) won and must authorize the deductions of such taxes, if any, from the prize(s) to the extent required by law. There will be only Three (3) Total Grand Prize $10,000.00 Winners issued for each of the first Three State Records Broken (as certified by the Official Record Keeping Authority) set between January 1, 2005, and December 31, 2005 for a Hog Rustler Brands total Liability for Prize Awards of NO MORE THAN $30,000.00 Total for the said Promotion. There will be only one Grand Prize paid to one winner in a specific State in the US (Excluding Alaska) The total Grand Prize package is $30,000.00, comprising $10,000 cash for each of the first Three State Records Broken (as certified by the Official Record Keeping Authority) set between January 1, 2005, and December 31, 2005.  All cash prizes will be awarded by check. Promotion winner(s) also agrees to travel at their own expense if needed to receive payment from Hog Rustler Brands at a Official Awards Dinner or Banquet as designated in writing by Hog Rustler Brands Inc.

4.     Strict Observance of Rules.  All-Tackle State Record Fish must be caught in accordance with all state, federal and local laws, codes, rules and regulations and must be caught in the manner prescribed by the International Game Fish Association (“IGFA”) international angling rules.  A copy of the IGFA rules is available from the Contest Sponsor at the Contest Registration Centers , Hog Rustler Brands Inc. PO Box 1546 Olive Branch MS 38654 , and on the Contest Sponsor’s website at HogRustler.com The Contest Sponsor will have no obligation to award prizes to any contestant who does not strictly comply in all respects with the Contest Rules, which include, without limitation, the rules of the IGFA which are incorporated by reference in the Contest Rules.

Hog Rustler Brands Inc.  reserves the right to disqualify any contestant who violates the spirit or letter of the Promotion Rules or whose conduct impairs, or damages or tends to impair or damage, the reputation or public image of the Promotion or Hog Rustler Brands Inc.

5.     Required Documentation.  In order to be confirmed as the winner of any prize, a contestant will be required to complete and execute, and deliver to Hog Rustler Brands Inc. within three business days of the catch of the  All-Tackle State Record Fish, a “Winner’s Affidavit and Release” in the form and manner prescribed by the Promotion  Sponsor confirming, among other things, the contestant’s compliance with the Promotion  Rules, acceptance of the prize as awarded and a release of claims.  Any winner of a $10,000.00 prize will be subject to a mandatory polygraph examination.  Failure of such Grand Prize winner or other prize winner to submit to and conclusively pass the polygraph examination will result in the disqualification of the winner.  Furthermore, with respect to any prize, regardless of value, after receipt of required documentation, Hog Rustler Brands Inc., in its sole opinion, may require the winner to be subject to the conduct of an investigation by Hog Rustler Brands Inc. or its designated independent judging organization, which investigation may include the requirement that the winner, witness(es) and Promotion  official(s) submit to and conclusively pass a polygraph examination as a condition precedent to the award of such prize.  In the event a winner is claimed, a Winners affidavit & release and Promotion Official's affidavit forms must be completed and signed by the claimed winner angler and Promotion  officials and submitted to Hog Rustler Brands Inc. for claim verification along with a copy of a government issued identification card containing a photo of the claimed winner. Original photographs are required of the catch. A clear picture of the side view of the entire fish is mandatory for proper species identification. Contest winner relinquishes all rights to Hog Rustler Brands Inc.  to utilize their name, their likeness, any pictures, articles, film, or other marketing material without further compensation other than original contest winnings unless otherwise provided by law.

6.     Assumption of Risk.  Fishing at any Lake , Reservoir or other body of water involves certain risks and hazards, including the risk of accidental injury or death to persons or loss or damage to property resulting from inclement weather, boating or other equipment accidents, drowning or other causes.  By entering the Contest, all contestants agree to release and hold harmless Hog Rustler Brands Inc., and their respective employees, shareholders, directors, officers, parents, subsidiaries and affiliates from and against any claims, demands, debts, obligations or liabilities arising from or relating to injury or death to persons or loss or damage to property suffered or incurred during or arising out of the contestants’ participation in the Contest. Hog Rustler Brands Inc.  will not be liable for any injury, damage, or other losses sustained to or caused by participating anglers.

7.     Discretion of Promotion Sponsor Rules Changes.  Decisions made by Hog Rustler Brands Inc. or its authorized representatives shall be binding and final as to all matters concerning the Promotion.  Promotion Rules are subject to change without notice up to the commencement of the Promotion  Period.  Any changes will be identified on the Contest Sponsor’s website at www.hogrustler.com

 8.     Legal Requirements.  This Promotion , the participation of all contestants and the awarding of prizes shall in all cases and for all purposes be subject to and subordinate to the requirements of applicable law. This Promotion  and all obligations of  Hog Rustler Brands Inc. shall be void to the extent prohibited by law.  

9.      Requirements.  This Promotion , the participation of all contestants and the awarding of prizes shall in all cases and for all purposes be subject to and subordinate to the requirements below:  

a. In order to be eligible for a prize, the All-Tackle State Record fish must be caught while using any Hog Rustler Brands Inc. Lure and in the manner prescribed by the International Game Fish Association ("IGFA") international angling rules. Any variance in this condition must be with the express written consent  Hog Rustler Brands prior to the start of the said promotion and contest.

b. Specified Species of  Fish: Largemouth Bass (As recognized by the IGFA). All waters must have been open to the public with unlimited access for fishing for at least one year immediately prior to the promotion. There must be an EXSISTING certified All-Tackle State Record recognized by the appropriate State Record Keeping Authority for the specified species, no Open or Vacant state records are eligible. (as defined in Hog Rustler Brands Inc. Official Promotion Rules and Item 2A herein).

c. Eligible Location: United States Waters Only

d. The total number of anglers eligible to participate in this promotion shall have no restriction

e. Tournament Headquarters:

f. Requisite Qualifications for Prize Award

    (i)    Fish must be eligible for and establish a new Official All-Tackle State Record weight for the specified species. Each state must have an existing State Record for the specified species and must have been keeping records for a minimum of five (5) years.

    (ii)    Fish must be caught while using any Hog Rustler Spinner Bait, Buzz Bait or Jig Bait Lure, used in a unaltered state.

    (iii)    Eligible angler must be able to show proof of purchase and  Lure must be identifiable in Photographs taken at the time of catch.

    (iv)     In order to be eligible, the All-Tackle State Record fish must ultimately be certified as the Official All-Tackle State Record for the specified species by the appropriate State Record Keeping Authority.

    (v)    All certification requirements will be the exclusive responsibility of the claimant. Notification of a record catch must occur within five (5) days of the catch, however, reasonable additional time will be allowed for State to certify catch and proof of loss to be established.

    (vi)     Any Grand Prize winner must submit to and pass a conclusive manner, a polygraph examination as a condition precedent to claim consideration. Required parties must sign normal and customary waiver as required by polygraph examiner and must present the conclusive results of the polygraph examination to Hog Rustler Brands Inc. in a reasonable period of time, but not to exceed 60 days of promotion conclusion in any event.

    (vii)     If there is a winner, (Winners Affidavit and Release) and (Witnesses' Affidavit), both must be completed in their entirety and returned in a timely manner to Hog Rustler Brands Inc.

g.          Eligible contestants. Any and all anglers adhering to the promotion rules and regulations of Hog Rustler Brands Inc.

h.        Failure or disregard of any of the terms and conditions of this agreement shall relieve Hog Rustler Brands Inc. of any and all liability here.

j.        Anglers will follow and adhere to all rules as as stated at (IGFA) listed at :  http://www.igfa.org/BookRule2004.pdf
